Terms of Service

These Terms of Service (the “Terms”) govern the use of the AI-powered brand management and social media automation platform (the “Service”) provided by İndoles Yazılım Anonim Şirketi (“Aduardo”, “we”) at aduardomind.com. By using the Service you are deemed to have accepted these Terms.

1. Description of the Service

Aduardo is a SaaS platform that helps brands manage their digital assets. The platform provides the following services:

  • AI-powered brand analysis and Brand DNA creation
  • Social media content generation (text and visuals)
  • Campaign planning and automated content calendar
  • Social media account integrations (Facebook, Instagram, WhatsApp, Telegram)
  • Automated content publishing and scheduling
  • Performance reports and analytics
  • Ad management
  • Team management and multi-user support

2. Account and Registration

  • You need to create an account in order to use the Service.
  • You agree to provide accurate and up-to-date information during registration.
  • You are solely responsible for the security of your account (password, access credentials).
  • You must notify us immediately when you become aware of unauthorized use of your account.
  • You must be over 18 years of age to use the Service.
  • Each user may open only one account.

3. Subscription Plans and Payment

3.1 Plans

The Service is offered under different subscription plans: Basic, Regular, Pro and Agency. Each plan has a defined credit limit, number of brands and user capacity. Current plan details are available on the Pricing page.

3.2 Credit System

AI-powered features (content generation, image creation, brand analysis, etc.) are used in exchange for credits. Each type of operation has a defined credit cost. Credits are renewed monthly and unused credits do not carry over to the following month.

3.3 Payment and Billing

  • Subscription fees are charged monthly.
  • Access to the Service may be suspended if payment is not made.
  • Price changes are announced at least 30 days in advance.

3.4 Free Trial

New users may benefit from a 14-day free trial. No automatic charge is made at the end of the trial period; you need to select a plan in order to continue.

4. Social Media Integrations

  • When you connect your social media accounts, operations are carried out in compliance with the API rules of the relevant platforms.
  • You are responsible for the content of the posts made through the accounts you connect.
  • You may remove an account connection at any time from the Settings (“Ayarlar”) page; the relevant access tokens are deleted immediately upon removal.
  • Some features may become temporarily or permanently unavailable due to changes in platform API policies.

5. AI-Generated Content

  • Text and visuals generated by AI are advisory in nature; we recommend reviewing them before publishing.
  • The accuracy, suitability or completeness of AI outputs is not guaranteed.
  • The publishing user is responsible for the compliance of the generated content with legal and ethical requirements and with platform rules.
  • Aduardo cannot be held liable for direct or indirect damages arising from AI-generated content.

6. Intellectual Property

6.1 Your Content

Content you upload to the platform or create with AI belongs to you. Aduardo uses this content solely for the purpose of providing the Service. We claim no rights over your content beyond the provision of the Service.

6.2 Aduardo’s Rights

The platform software, design, logos, algorithms and all technological infrastructure belong to İndoles Yazılım Anonim Şirketi. These elements may not be copied, reproduced or reverse engineered without permission.

7. User Responsibilities and Prohibitions

You agree to comply with the following rules while using the Service:

  • Not to create unlawful, misleading or defamatory content, or content that infringes the rights of others
  • Not to send spam or unsolicited messages, or to make automated bulk posts
  • To refrain from actions that would endanger the security of the platform
  • Not to abuse API or system resources (rate limit violations, DDoS, etc.)
  • Not to gain unauthorized access to other users’ accounts
  • Not to use the platform outside its intended purpose (crypto mining, proxy server, etc.)

In the event of conduct contrary to these rules, your account may be suspended or permanently closed, with or without prior warning.

8. Team Management

  • The team owner determines the access levels of team members (Owner, Editor, Viewer).
  • Users invited to a team access the relevant brand data within the scope of the assigned role.
  • The team owner is responsible for the actions of its members (publishing, content creation, etc.).

9. Service Level and Availability

  • It is not guaranteed that the Service will operate uninterrupted or error-free.
  • Planned maintenance work is announced in advance.
  • Aduardo cannot be held responsible for outages in third-party services (social media APIs, AI providers).
  • Changes to the scope of the Service are notified to users.

10. Cancellation and Termination

  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • You may delete your account from the Settings (“Ayarlar”) page. Deletion cannot be undone.
  • In the event of a breach of the Terms, Aduardo reserves the right to suspend or close your account.
  • When an account is closed, your data is handled in accordance with the Data Deletion Policy.

11. Limitation of Liability

Aduardo cannot be held liable for direct, indirect, special, incidental or consequential damages (including loss of profit, loss of data or loss of reputation) arising from the use of the Service. Aduardo’s total liability cannot exceed the subscription fees you paid in the last 12 months.

12. Changes

Aduardo reserves the right to change these Terms upon prior notice. Material changes are announced at your registered email address and/or through an in-app notification. Continuing to use the Service after a change means that you accept the current Terms.

13. Governing Law and Disputes

These Terms are subject to the laws of the Republic of Türkiye. The Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction over disputes.
